Forced Marriage in Islam

Forced Marriage is not permissible in Islam.Both the guardian and the woman must agree to the marriage.

Allah Almighty Said in the Noble Quran:

O you who believe! You are forbidden to inherit women against their will, and you should not treat them with harshness, that you may take away part of the Mahr you have given them, unless they commit open illegal sexual intercourse. And live with them honorably. If you dislike them, it may be that you dislike a thing and Allâh brings through it a great deal of good. [Surah An-Nisa' 4:19]

The Messenger of Allaah (peace be upon him) said:“A previously-married woman should not be married without being consulted, and a virgin should not be married without asking her permission.” They said, “O Messenger of Allaah(pbuh|), how is her permission given?” He said, “By her silence.” (Reported by al-Bukhaari, 6455).

‘Aa’ishah(RA) reported that a girl came to her and said, “My father married me to his brother’s son in order to raise his social standing, and I did not want this marriage [I was forced into it].” ‘Aa’ishah(RA) said, “Sit here until the Prophet (pbuh) comes. The Messenger of Allaah (pbuh) came and she told him about the girl. The Prophet (pbuh) sent for her father, then he gave the girl the choice of what to do. She said, “O Messenger of Allaah, I have accepted what my father did, but I wanted to prove something to other women.” (Reported by al-Nisaa’i, 3217).

Narrated ‘Aisha(RA):

I asked the Prophet,(pbuh) “O Allah’s Apostle! Should the women be asked for their consent to their marriage?” He said, “Yes.” I said, “A virgin, if asked, feels shy and keeps quiet.” He said, “Her silence means her consent.”Volume 9, Book 85, Number 79: Sahih Bukhari

Narrated Khansa bint Khidam Al-Ansariya(RA):

That her father gave her in marriage when she was a matron and she disliked that marriage. So she went to Allah’s Apostle(pbuh) and he(pbuh) declared that marriage invalid. Volume 7, Book 62, Number 69: Sahih Bukhari

Narrated Ibn Abbas(RA):

Regarding the Divine Verse: “O you who believe! You are forbidden to inherit women against their will, and you should not treat them with harshness that you may take back part of the (Mahr) dower you have given them.” (4.19) (Before this revelation) if a man died, his relatives used to have the right to inherit his wife, and one of them could marry her if he would, or they would give her in marriage if they wished, or, if they wished, they would not give her in marriage at all, and they would be more entitled to dispose her, than her own relatives. So the above Verse was revealed in this connection.
